The sinologist George Thomas Staunton learned Chinese as a child & accompanied his father on a trip to China in 1792 where, though the Ambassador's page, he was the only member of the delegation who could speak to the emperor in Chinese. A career in the East India Company's Canton factory followed, & he translated many texts between Chinese & English, including this penal code, published in 1810, which was its first translation into any European language. The 'Fundamental Laws' was the legal code of the Qing Dynasty, & contained more than 1,000 statutes. Staunton organised his translation of a selection of the laws into seven divisions: general, civil, fiscal, ritual (religious), military, criminal & public works. He also includes an appendix with translations of edicts regarding matters such as punishment, making this compendium an invaluable guide to the complex legal regime of the Qing Dynasty.

This text is a collection of writings on assigned topics by some scholars and lecturers in the Faculty of Law at Benson Idaho State University and those invited from outside the university. The idea to write a text for use in the study of legal methods for law students was borne out of the desire to present a range of updated material in this area of study. Along with the required knowledge, it is experience in practical dealings with examination situations that is of particular significance. Since the first results of the intermediate examination are called for very early on in the degree course, there is a need for concentrated information. It is this information that our special edition seeks to offer, namely as a methodical support. This way, the required confidence in handling legal texts can be acquired and the interim examination crowned with success. Die Anfängerübungen in der Universitätsausbildung sind - als Voraussetzung für die Zulassung zu den Übungen für Fortgeschrittene - nach wie vor an zahlreichen Universitäten wichtige Ausbildungsabschnitte. An den Universitäten, die die Anfängerübungen abgeschafft haben, verlagert sich das Schwergewicht automatisch auf die Übungen für Fortgeschrittene. Gleichwohl hält sich der "Examensdruck" in den Übungen in einem erträglichen Maß, da die Übungen bis zum erfolgreichen Abschluss wiederholt werden konnten und können. Mit Einführung der Zwischenprüfung hat sich die Ausbildungslage entscheidend geändert. Der Misserfolg in einer Zwischenprüfungsklausur kann - auch wenn eine Wiederholungsmöglichkeit besteht - schnell zum abrupten Ende des juristischen Studiums führen. Wichtig ist es daher, dass der Student sich rechtzeitig Kenntnisse darüber verschafft, was in den einzelnen Prüfungsleistungen von ihm erwartet wird. Neben dem erforderlichen Wissen ist aber die Übung im praktischen Umgang mit Prüfungsfällen von besonderer Bedeutung. Da die ersten Leistungen der Zwischenprüfung schon sehr früh im Studium verlangt werden, besteht ein Bedürfnis nach konzentrierter Information. Diese Information will das Sonderheft bieten, und zwar als methodische Hilfestellung. Um das eigene Wissen und Können zu erweitern, aber sogleich kritisch zu analysieren, ist es erforderlich, nach Kenntnis des Klausursachverhalts eine Lösungsskizze zu erarbeiten und diese mit der abgedruckten Falllösung zu vergleichen. So kann aus Fehlern gelernt, die nötige Sicherheit im Umgang mit dem Rechtsstoff gewonnen und die Zwischenprüfung erfolgreich bestanden werden.

This is an introductory book on African legal philosophy. The book claims that African legal philosophy exists and is intelligible in the context of African culture, just as every other legal philosophy has its cultural foundation. What law is, how it is thought, how it is interpreted, and how it is applied takes place with thing the parameters of African culture. At a time when the imposition of Western culture on Africans has to be reckoned with, African legal philosophy is, in part, a response to this imposition. It ought to have a liberating effect.
